Know Your Rights

  1. When pulled over in your vehicle always ask why you were stopped. Failure to stop a vehicle without probable cause or reasonable suspicion constitutes an unreasonable seizure in violation of your legal rights.
  2. No matter how busted you think you are never consent to allowing the officer to search your vehicle or home. All individuals have a right to be free from "unreasonable" searches and seizures. Tell the officer that unless they have a search warrant it is going to be without your consent.
  3. NEVER, under any circumstances, give a statement to the police without the presence of counsel. Be courteous but firm. You have a right to remain silent and this silence can not be used against you. Do not allow the officer to abuse this right. (The key rule: the harder the officer tries to get a statement the weaker his case is against you)
  4. The Commonwealth has the burden of producing the evidence against you. Never admit to anything.
  5. Seek the advice of competent counsel immediately. The longer you wait the weaker your defense may become.
