Harsh Virginia Penalties for Driving With Suspended License

The state of Virginia has harsh penalties. A first offense is a Class 1 misdemeanor with the possibility of 12 months in jail, $2500 in fines and 12 months loss of license. Furthermore there is mandatory minimum sentencing for subsequent offenses. This means that a judge has no room for discretion or leniency and will hand down the requisite punishment. These harsher penalties include:

  • Third subsequent offense: mandatory minimum time in jail of 10 days
  • Habitual offenders: either 30 days in jail or 12 months mandatory minimum (depending on whether charge was misdemeanor or felony)

License suspensions generally may have occurred as a result of nonpayment in fines, nonpayment of child support or by court order for certain convictions such as a DUI or possession of drugs.
