Petition for Guardianship/Conservatorship
Once it is determined that a guardianship/conservatorship is in the best interest of a loved one, a doctor must then make a determination that the person is not competent and lacks the capacity to manage their own affairs.
A petition for guardianship/conservatorship is then filed in the circuit court in which the incapacitated person has lived for the six months prior to the date of filing. Once this is filed, notice is given to immediate family members. The court will then hold a hearing to determine whether the individual actually is in need of the service. A guardianship/conservatorship power can generally be given to an individual or organization, such as an assisted-living facility.
