A recent automobile accident in Virginia Beach has led to criminal charges filed against the driver. Reports state that the 43-year-old woman was driving her truck through a residential area early in the morning. While driving through the neighborhood, she averted a school bus, which was stopped on the side of the road. She then lost control of the vehicle, however, drove into a resident's yard, and struck a father and three children who were walking down their driveway to catch the school bus. The woman has been charged with DUI, assault, and other offenses.

One of the children has been released from the hospital. The father and another of the children remain hospitalized in good condition. The third child, however, is listed in critical condition.

The driver has a prior DUI on her record from 2003. Her license was revoked in 2003, but she has since had her license reinstated. She has not had any DUI related offenses since 2003.

In her most recent court appearance, the woman, through her attorney, withdrew her demand for a bond hearing. She can request another hearing in the future, but she will presently remain in custody. She has a preliminary hearing on March 2.

Drunk driving in Virginia carries with it many potential consequences. There are criminal penalties and restrictions placed on the driver's license. Drivers charged with DUI may not know all the defenses available to them. But an experienced DUI attorney will be able to fully inform the driver of her rights and explain the court procedures that the driver will face.
