In a criminal or juvenile case, a “bond” is money or property a defendant gives to the court as security instead of staying in jail, pending the outcome of their trial.

Posting bond helps ensure that a defendant appears for future criminal proceedings and trial. If the defendant attends all required proceedings, the court returns their bond money. If a defendant does not appear in court, they forfeit their bond.

A magistrate determines whether to allow the defendant to post bond. The defendant can appeal a bond denial at the arraignment level. In determining whether bond is appropriate, courts will consider whether the defendant is a flight risk or presents a danger to others or themselves.
