Penalties
If a person sexually abuses a child between the ages of 13 and 15 without force, the individual is guilty of a Class 4 felony. The punishment for the crime includes 2 to 10 years in prison and potentially a fine up to $100,000. If the crime involves an individual who is at least 3 years older than the child, and the child consents to the sexual acts, the individual is guilty of a Class 6 felony. A Class 6 felony could result in 1 to 5 years in prison, up to 12 months in jail, and / or a fine of up to $2,500.
In cases where the individual is less than 3 years older than the child, and the child consents to the acts, he or she is guilty of a Class 1 misdemeanor, which can lead to a 12-month jail sentence and / or a fine of up to $2,500.
And individual convicted of child sexual abuse twice will be required to enroll in the Sex Offender Registry, which is open to the public and will likely lead to public censure.
