Child Protective Services is managed by the Virginia Department of Social Services. When child abuse allegations are reported, Child Protective Services determines if the case meets local or state definitions and acts to ensure a child’s safety. This report can be made anonymously.

The CPS Investigation

Child Protective Services has a responsibility to evaluate child safety and prevent abuse and neglect. However, they also support the reconciliation of families.

A social worker begins their investigation by notifying you of the report and conducting electronically recorded interviews. The social worker can speak to your child without your presence or permission. They will also review your child’s living conditions and conduct a safety assessment.

Per The Code of Virginia, a CPS investigation must be completed within 60 days of the report. If law enforcement is involved, this timeline can be extended to 90 days. A CPS investigation can lead to criminal charges.

Fighting the Outcome of Child Abuse Charges

Child Protective Services will notify you when the investigation is complete. You can request to see a copy of the CPS investigation report from your local department of social services. If you disagree with the outcome of the investigation, you must submit a written request to social services within 30 days of the notification to purge your record. A CPS attorney can assist you during the investigation and in fighting the results.
