What to Know About QDROs
A QDRO is a court order that gives an “alternate payee” the right to receive all or a portion of a retirement plan participant’s benefits. QDROs apply to 401(k), 403(b), and other similar plans. They do not apply to IRAs.
Who Can Be an Alternate Payee?
Only four categories of people can qualify to be an alternative payee.
These include a plan participant’s:
- Ex-spouse
- Child
- Legal dependent
Why Courts Enact QDROs
Retirement assets you or your spouse gain during marriage can be subject to distribution in divorce. As a result, the courts may enact a QDRO to divide marital property equitably, but will require one or both parties to prepare the QDRO for entry. An attorney can help you with this.
Similarly, a QDRO may be necessary to allow you or your ex-spouse to receive retirement funds to satisfy the terms of a child or spousal support agreement.

The first thing you should do when facing this issue is consult one of our experienced attorneys. - Notifying the appropriate retirement plan administrator once the order has been approved
