Virginia Embezzlement Penalties
Embezzlement is considered a type of property theft. It happens when a person – who was in charge of managing or monitoring someone else’s money or property – steals all or a portion of that money or property for personal gain.
In order to be convicted of embezzlement, the defendant must have had legal access to another person’s money or property, but not legal ownership of it. Since the act of taking of money or property is stealing, the combination of these two elements results in the unique crime of embezzlement.
In Virginia, embezzlement is punished according to the value or property stolen. If the money or property is worth less than $200, then the crime may be punishable by a jail sentence of up to one year and a maximum fine of $2,500. If the money or property is worth $200 or more, then the crime may be punishable by a prison sentence of up to 20 years.
