When Does a DUI Become a Felony in Virginia?

Virginia law classifies most DUI offenses as misdemeanors. Under Va. Code § 18.2-270, specific circumstances elevate a charge to a Class 6 felony or higher. A DUI becomes a felony in Virginia in these situations:

• Third Offense Within 10 Years: A third offense within 10 years is a Class 6 felony, regardless of the current BAC or the circumstances of the current arrest.
• Fourth or Subsequent Offense: A fourth or subsequent DUI is also a Class 6 felony under § 18.2-270. A person previously convicted of a felony DUI who is later convicted of any DUI offense may face a Class 6 felony charge regardless of when the prior felony occurred.
• DUI Maiming (Serious Bodily Injury): If a DUI results in serious bodily injury to another person, the driver may be charged under Va. Code § 18.2-51.4, a Class 6 felony carrying 1 to 5 years in prison. If the injury results in permanent and significant physical impairment, the charge rises to a Class 4 felony.
• DUI Causing Death: A DUI that results in a fatality can be charged as involuntary manslaughter or aggravated involuntary manslaughter under Va. Code § 18.2-36.1, with significantly higher penalties.

How a Felony DUI Moves Through Virginia Beach Courts

The process begins with a preliminary hearing in General District Court, where the Commonwealth must demonstrate probable cause that a crime was committed. This hearing is a critical early opportunity: if the evidence doesn’t meet the threshold, the case doesn’t proceed. If the judge finds probable cause, the case is certified to a grand jury. A grand jury indictment then transfers the case to Virginia Beach Circuit Court for trial.
